Clarification request 

Question no 01

A.      According to the published tender documentation Contract title : Procurement equipments (Supply) -                                                                                                         Publication reference : RORS 283/8 eMS , in the document SUPPLY CONTRACT NOTICE EQUIPMENT PROCUREMENTS at point 23. Additional information it is written:

“The offer will include the following documents:

-          Certified copy of  Financial sheets for the last 3 years

-          Certified copy of  Registration certificate from Trade Registry

-          Informational certificate issued by Trade Registry no later than 30 days before submission deadline – in original

-          Fiscal certificate proving the lack of debts toward state budget, in period of validity at offer opening day – in original

-          Fiscal certificate proving the lack of debts toward local budget , in period of validity at offer opening day – in original”

Please clarify the following issues:

1.            “Certified copy of Financial sheets for the last 3 years” .

-It is about closed Budget report financial sheets for 2017, 2018 and 2019 ?

-What do you mean by “Certified copy”, a notary registered copy or a “conformal with the original” copy certified by the bidder and signed by the Duly Authorized signature? A Romanian language copy is accepted or only an authorized English translation ? Please be informed that the amount of documents for this requirement is about 80 pages and the notary registrtation and authorized translation will be very expensive and will take a long time to translate. Only the “Profit and Loss” section for each year will be acceptable? Please advise!

2.  “Certified copy of  Registration certificate from Trade Registry”

- What do you mean by “Certified copy”, a notary registered copy or a “conformal with the original” copy certified by the bidder and signed by the Duly Authorized signature? Or you mean an authorized translation in English only? The Romanian version is acceptable? Please advise!

3.        “Informational certificate issued by Trade Registry” no later than 30 days before submission deadline – in original

-The Romanian version is acceptable or only the authorised English translation? Please advise!

        4.    “Fiscal certificate proving the lack of debts toward state budget”, in period of validity at offer opening day – in original

-The Romanian version is acceptable or only the authorised English translation? Please advise!

        5.    “ Fiscal certificate proving the lack of debts toward local budget” , in period of validity at offer opening day – in original”

1.1 The offer must be in English language, but the support documents ( including Certified copy of  Financial sheets for the last 3 years, Certified copy of  Registration certificate from Trade Registry,  Informational certificate issued by Trade Registry no later than 30 days before submission deadline, Fiscal certificate proving the lack of debts toward state budget, Fiscal certificate proving the lack of debts toward local budget)
coud be in an European language. For this procurement, all suport documents issued in Romanian language will be accepted.
1.2."Certified copy of Financial sheets for the last 3 years” means the Anual Budget report financial sheets for 2017, 2018 and 2019
1.3. A "certified copy" means a copy of an original document, signed by each page by the legal representative of tenderer and bearing the words " accordingly to the original"
1.4. The request was: “Informational certificate issued by Trade Registry” no later than 30 days before submission deadline – in original-, so the Romanian version of the original document is acceptable if the tenderer is registered in Romania. If not, an english version or a certified translation in English or Romanian language will be accepted, beside the original document.
1.5. The Romanian version of  “Fiscal certificate proving the lack of debts toward state budget” is acceptable if the tenderer is registered in Romania. If the tenderer is not registered in Romania, an english version or a certified translation in English or Romanian language will be accepted, beside the original document.
1.6  The Romanian version of  “Fiscal certificate proving the lack of debts toward local budget” is acceptable if the tenderer is registered in Romania. Question no 2: 
In the “Financial identification form “ must be issued the RON IBAN account of the company and not the EUR IBAN account? The RON IBAN account must be the account from the commercial bank or from the  State Treasury ? Which account will be used for payment?

Accordingly to the Romanian Fiscal Code, all payments made on Romania must be made in national currency, meaning RON. SO, the “Financial identification form “ must refer to RON IBAN account from the  State Treasury. The Inforeuro exchange rate from the month of invoice will be used to calculate the equivalent value in RON.
